New York Rep. Vito J. Fossella, who represents the 13th Congressional District, is having a bad week. The 43 year old was arrested for DUI on May 1st, in Alexandria Virginia as reported by The New York Times.

The married father of three has issued a statement detailing his drunken driving charge and also dropped a huge bombshell indicating that he has had an extramarital affair with Laura Fay and the two have a 3 year old daughter together.

Fay, a former Air Force lieutenant colonel, was the person that Fossella called to bail him out after being picked up on the DUI charge. He told the arresting officer that he was on the way to visit a sick daughter when he was stopped, and gave the address as Fay’s. His blood alcohol level was twice the legal limit, which carries a mandatory 5 days in jail if he is convicted.

Fossella, a Republican who has served 5 terms in the U.S. House, issued the following statement:

I have had a relationship with Laura Fay, with whom I have a three-year-old daughter. My personal failings and imperfections have caused enormous pain to the people I love and I am truly sorry. While I understand that there will be many questions, including those about my political future, making any political decisions right now are furthest from my mind. Over the coming weeks and months, I will to continue to do my job and I will work hard to heal the deep wounds I have caused.

The House ethics committee also could open an investigation into the matter. The panel must begin an investigation of a House member accused of a crime within 30 days, or report to the House why it is declining to investigate.

Fossella and his wife, the former Mary Patricia Rowan, married in 1990. They have two sons and a daughter. On Wednesday, Mr. Fossella attended a confirmation ceremony for his oldest child at St. Clare’s Roman Catholic Church in the Great Kills neighborhood of Staten Island, before returning to Washington.

Fossella has a court appearance slated for May 12th, in Alexandria, Virginia District Court.
