Sam Lutfi, the controversial former manager of Britney Spears, filed a lawsuit for wrongful termination, breach of contract and defamation after he was fired. Named in the suit are the popstar and her parents Jamie Spears and Lynne Spears.

Lutfi, who initiated the legal action after a judge issued a restraining order to keep him away from the Spears family, has hit a roadblock in his attempt to coerce Britney to appear at a deposition hearing. Lawyers continue to argue that she is “not competent” to testify.

Spears and her estate have been under a court-approved conservatorship since February 2008. In the eyes of the court, she is viewed as a child who is under the full control of her father.

The disgruntled former manager finds fault with her “incompetence” status based on the fact that she has toured, recorded, done media interviews and TV appearances. His lawyer has asked a judge to allow an “independent medical examination” to prove that Britney is fully capable of being deposed by his lawyer.

A lengthy psychiatric examination would focus on mental status, psychiatric symptoms, substance and alcohol-use history, and the medications that Spears is currently being prescribed for her bipolar disorder.

The Spears family firmly believes that the talented musician’s condition deteriorated while she was under the controlling influence of Lutfi. They convinced a judge that it would be detrimental to Britney to continue her association with him.
