During an emergency hearing on Friday, Tameka Foster and her lawyers were shut down by a judge who stated emphatically that there was zero evidence to support a claim that her sons were in eminent danger while living with their father Usher.

The hearing, streamed live by TMZ, captured the testimony of the parents and other caregivers.

Foster was deeply concerned because her children are being cared for by Usher’s family members who may not be physically capable of rendering the kind of care needed by active children – as evidenced by their inability to rescue Usher V from the bottom of the family pool earlier this week.

She also alleged that her ex-husband failed to notify her until 45 minutes after her 5-year-old son nearly drowned — calling it part of a pattern that has kept her in the dark regarding the status of her boys since he was awarded primary custody in late 2012.

The judge told Tameka that there probably wasn’t a single person sitting in the courtroom who has not been cared for by a grandmother or an aunt at some time.

While ruling that the boys will remain in the care of their father, he did caution Usher to be more open in his communication with the children’s mother.

Usher approached his ex-wife after the hearing and hugged her in a prolonged embrace. When asked about it afterward, Foster wasn’t willing to say more than, “That was for the media.”

She tweeted last night, “When life doesn’t make sense, remember the universal system is beyond anything we can comprehend. We don’t need to see it. Just trust it.”

This morning she added, “I feel great this morning! My son and I got a good nights sleep. Didn’t hear the nurses fumbling around. Yaaay, I usually sleep so light.”
