Lindsay Lohan rehab

Lindsay Lohan has reportedly blown off a court-sanctioned plan to check into a New York rehab facility because they won’t bend the rules and let her smoke.

The judge was told she would enter the Seafield Center in Westhampton Beach, New York on Thursday, May 2.  She definitely won’t be doing that because she got on a private jet last night for a flight back to California.

TMZ is reporting that she will enter Morningside Recovery in Newport Beach, CA, where she can puff away during her 90 day stay.

Her lawyer is due back in court today and will have to explain the change of plans to a judge who may not be impressed with her 11th hour decision.

According to Morningside’s website: “On a daily basis, clients take walks, jog, surf and watch the sun set into the ocean. A short list of the many group activities includes trips to Disneyland, kayaking, miniature golf, hiking, sailing to Catalina Island and other experiences that are fun, enjoyable and therapeutic for those struggling with substance abuse.”

Without prior approval by the L.A. City Attorney or the Santa Monica City Attorney, Lohan is in violation of her plea deal and could land in jail for 90 days.

David Letterman and Lindsay Lohan

Dave Letterman grilled his ‘Late Night’ guest Lindsay Lohan about her upcoming court-ordered rehab stay during their Wednesday evening interview.

Lohan was on the show to promote her appearance in ‘Scary Movie 5′ but the show host had other plans.

The actress managed to get in a few digs at Dave.  When asked, “Aren’t you supposed to be in rehab now?” Lohan responded, “Don’t you watch anything that goes on? What are you a tabloid now?”

Lindsay acknowledged that she will enter rehab on May 2nd for a 90 day stint.   She put a positive spin on things, referring to her recent court sentence as “a blessing and not a curse.”

Lindsay pleaded no contest on March 18 to reckless driving and lying to a police officer, stemming from her car crash on the Pacific Coast Highway last summer. Trial Sentencing Update:  A plea deal was negotiated, with Lohan serving 90 days in a lockdown rehabilitation center.  She must also complete 18 months of psychotherapy, with credit for session time already completed.

The judge also explained that Lindsay must submit immediately to a search and seizure of her personal property at any time per the request of police or other officers of the court.

Following rehab she must complete thirty days of community service in New York.

Attorney Mark Heller spoke to reporters after court.  He said, “Justice was served today.  Lindsay was afforded an opportunity to address the allegations against her.  The prosecutor treated her fairly.  Lindsay has indicated that she was extremely gratified with the outcome.”

His statement was interrupted by Michael Lohan, who charged the podium to hurl insults at the legal eagle and  threaten him with disbarment because he kept Lindsay in the dark about what was really going on behind the scenes, and “lied to her.”

The dramatic grandstanding stunt by LiLo’s father in front of the press was typical and we’re not totally sure if he was blowing smoke or had some legal basis for his allegations of client misrepresentation.  For that matter … since when did Lindsay allow her father to get involved in her legal affairs?  The answer is NEVER.

Heller must return to the L.A. court on May 2nd to provide proof that his client is enrolled in a rehabilitation program.

Lindsay Lohan‘s trial was supposed begin this morning promptly at 8:30 a.m. PDT.  She made her grand appearance 48 minutes late … which is nothing unusual for her.

The struggling actress will attempt to counter a charge of lying to police after crashing her Porshe last June on Pacific Coast Highway.

She was offered a plea bargain that included rehab and house arrest but she has decided to leave her punishment up the a jury.  If convicted she could spend 2-3 months behind bars followed by a lengthy rehab stint.

The truck driver involved in the crash is in the courtroom as well as Lindsay’s father Michael Lohan.

Lohan was on board a commercial flight from New York yesterday but got off during a delay caused by a suspected fuel leak.  Ironically, that flight did arrive safely in Los Angeles at 11:30 p.m. Sunday night.

In a last ditch effort to get from one coast to another, she called a business contact at Pink Energy Drink, who arranged the flight to LAX on their private jet, which took off at 4:00 a.m. eastern.  The plane landed at LAX at 8:35 a.m., a 20 minute drive from the courthouse.

To show her appreciation, Lohan tweeted, “Thanks Mr. Pink for the private jet.  See you all in a few hours in LA. @drinkmrpink @sheerazhasan”

She arrived 48 minutes late wearing a white dress that she put on in the car during the drive from the airport.  As she strolled into the courthouse someone in the crowd threw gold glitter in her direction.

Lindsay Lohan and Mark Heller a dynamic duo

According to her new lawyer, Lindsay Lohan has decided to turn her life around and hopes to become an inspirational speaker.

Mark Heller sent a letter to prosecutors and an L.A. judge in preparation for their meeting on Friday to negotiate a settlement involving the reckless driving and obstruction charges she picked up after slamming her Porsche into a truck on the Pacific Coast Highway in June.

Heller wrote, “Lindsay has asked me to facilitate an in-person meeting with the prosecutor…not to discuss the merits of her defense but rather for Lindsay to introduce herself and personally affirm her commitment and dedication to fixing the problems.”

“Lindsay will gladly be participating in intensive psychotherapy, submitting herself to regular screenings and contributing her time to the production of public-service messages and periodic visits to schools, hospitals and other venues where she may provide inspirational talks, encouraging children to pursue positive goals and avoid bad habits.”

Lohan, 26, could face 245 days in jail if a judge decides her conduct in June 2012 violated the terms of her probation that was set when he let her off the hook on the 2011 necklace theft.

Her legal eagle plans to ask the judge to dismiss the case against Lohan because officers did not comply when she asked to speak with an attorney before they interviewed her.  Because every savvy lawyer has a Plan B, he fired off the letter promising all of the wonderful things that his client would do to make up for past wrongs.
